On April 22, 2019, the secretariat of SCIMEA held the seventh internal training, which was shared by Tong Tong, a legal adviser of SCIMEA and lawyer of Sichuan Tianrun Huabang Law Firm with the title Legal thinking and legal system.
Mr. Tong firstly introduced the China’s legal system compared with other foreign legal systems, and put forward some questions for discussion. In positive thinking and heated discussion, Tong Tong proposed that China's cultural characteristics made us more accustomed to directly coming to the results from the facts, but sometimes it is not comprehensive and meticulous. Mr. Tong mentioned that in daily affairs, we should learn and grasp the skills of how to "investigate and research things", how to "gain knowledge from things", and how to view problems dialectically. By introducing "hypothesis", "facts" can be dissected into more clear and detailed regulations, so we can apply legal thinking in all aspects of work and life.
In the second half of the training, Mr. Tong shared some classic cases and common thinking mistakes with the audience. He also pointed out that the articles of law in many cases can be described but not defined. In practical work, we should combine the actual background, carefully analyze and deduct specific case, instead of being dogmatic, to draw legal and appropriate conclusions.
Under the guidance of lawyer Tong, all colleagues who participated in the training conducted a review and analysis of their previous work with legal thinking.
